Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of IQAI, an AI-powered educational tutoring platform operated by SupaDupaAI Ltd ("we", "us", "our"). By creating an account or using our service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our service.

2. Service Description

IQAI provides AI-powered educational tutoring for children in the UK education system (Year 7 to Year 13), including structured workbooks, an AI tutor, past paper revision assistance, and parental controls. The service is designed for use by parents/guardians who create and manage accounts on behalf of their children.

3. Account Registration

• You must be at least 18 years old and a parent or legal guardian to register.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity under your account, including your children's usage.
• You must provide accurate and complete information during registration.
• You may create profiles for up to 5 children under your family account.
• Child accounts are created using a first name and PIN. You are responsible for setting appropriate PINs.

4. Parental Responsibility

As the account holder, you are responsible for your children's use of IQAI. This includes setting appropriate help levels (Red, Amber, or Green mode), monitoring progress through the parent dashboard, approving or denying requests for additional help, and ensuring your child uses the platform appropriately. You acknowledge that the AI tutor provides educational guidance and is not a substitute for professional teaching or pastoral care.

5. Acceptable Use

You and your children must not:

• Use the service for any unlawful purpose.
• Attempt to extract, store, or redistribute any copyrighted exam content.
• Share account credentials with anyone outside your immediate family.
• Attempt to bypass parental controls or help mode restrictions.
• Use the AI tutor for purposes unrelated to education.
• Introduce viruses, malware, or attempt to access systems without authorisation.
• Resell, sublicense, or commercially exploit any part of the service.

7. Intellectual Property

• Our content: All workbook questions, educational content, and platform design are original works created by SupaDupaAI Ltd and are protected by copyright.
• Past papers: IQAI does not store or reproduce any exam board content. We link to official exam board websites. All past papers and mark schemes are the copyright of their respective exam boards (AQA, Pearson/Edexcel, OCR, WJEC, CCEA).
• AI responses: AI-generated responses during tutoring sessions are provided for personal educational use only and may not be reproduced commercially.
• Your content: You retain ownership of any content you create (e.g., notes, conversation history). By using the service, you grant us a licence to process this content for service delivery.

8. Pricing & Payments

• The current pricing is a trial month at the advertised rate, followed by an annual subscription.
• Payments are processed securely by Stripe. We do not store your card details.
• You may cancel your subscription at any time from your account settings.
• Refund requests are handled on a case-by-case basis. Contact us within 14 days of payment for a full refund if you are dissatisfied.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be honoured at their current rate until their next renewal date.

9. AI Credits & Usage Limits

Your subscription includes a monthly allocation of AI tutor credits. Credits are consumed when your children interact with the AI tutor or exam assistant. Parents can monitor credit usage from the dashboard. If credits are exhausted before the month ends, AI features will be temporarily unavailable until the next billing cycle. Workbooks and past paper links remain accessible regardless of credit balance.

Additional credit packs can be purchased from the Wallet page. Purchased credits do not expire and persist across billing cycles. When credits are consumed, included monthly credits are used first, then purchased credits.

10. Referral Programme

IQAI offers a referral programme allowing parents to earn credits by referring new families. The programme is subject to the following terms:

• Each registered parent receives a unique referral code that can be shared with friends and family.
• When a new parent registers using your referral code AND subscribes to the annual plan, you become eligible for a reward of 200 credits (equivalent to £20 in value).
• The reward is issued only after the referred user's 14-day statutory cooling-off period has passed and their subscription remains active.
• The referred user must also verify their email address and have at least 5 AI tutor conversations before the reward is issued. This ensures genuine platform usage.
• Once the 14-day cooling-off period has passed and the reward is issued, it is permanent. The annual subscription payment is non-refundable after the statutory cooling-off period under UK Consumer Contracts Regulations 2013.
• There is a maximum of 20 rewarded referrals per user (£400 maximum earning potential).
• Referral credits are added to your purchased credits balance and can be used for AI tutor sessions. Credits cannot be withdrawn as cash or transferred to other users.
• Self-referral is prohibited. You cannot use your own referral code or create multiple accounts to earn referral rewards.
• Cross-referral gaming is prohibited. If User A has referred User B, then User B cannot refer User A.
• We reserve the right to suspend or terminate referral rewards if we detect fraudulent or abusive behaviour.
• We may modify or discontinue the referral programme at any time with 14 days' notice. Pending rewards for referrals already made will be honoured.

11. Availability & Changes

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may temporarily suspend the service for maintenance, updates, or improvements. We reserve the right to modify, update, or discontinue features with reasonable notice. If we discontinue the service entirely, we will provide at least 30 days' notice and a pro-rata refund for any unused subscription period.

12. Limitation of Liability

To the fullest extent permitted by law, SupaDupaAI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim relating to the service shall not exceed the amount you paid in the 12 months preceding the claim. Nothing in these Terms limits our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

13. Termination

• You may close your account at any time from your account settings or by contacting us.
• We may suspend or terminate your account if you breach these Terms.
• Upon termination, we will retain your data in accordance with our Privacy Policy retention periods.
• You may request a GDPR data export before closing your account.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
